Judge Nevin Dawson's Kim Dotcom and his co-accused Mathias Ortmann, Bram van der Kolk and Finn Batato includes a summary of the maximum prison sentences facing the four on each charge if they are ultimately convicted in the US. I would doubt any file service maintains multiple copies of the same file (inefficient storage space use) rather than multiple links to the same file.

This seems like an IT-ignorant argument the Crown and the US have used, trusting it will sway those who know no better. Google and YouTube both pay contributors for traffic, just as MegaUpload did. The USA chose MegaUpload to make an example of, likely trusting that an obnoxious fat German wouldn't gather too much public sympathy. I think they underestimated Kiwis' disgust at the apparent corrupting of separation of branches of NZ government (e.g.

'brownie points'), and unduly heavy influencing of our government by the USA. Many of us are not comfortable that a militarised raid over Coatesville was carried out at the behest of Hollywood lobbyists, to take down someone arguably for second degree copyright infraction.

(Everyone knows the money laundering charges were tacked on because you cannot extradite for violating copyright.) Key & Co have made much of New Zealand feel the need for a good strong shower and scrubbing to get rid of the stench from this case. We don't feel that the life of an individual is a worthy price for being 'part of the club'. Copyright breach is stealing. Both here and in the US. Intangibles, such as Digital or software property are treated exactly the same as physical items and law was amended a few years ago in NZ. Keep telling yourself that it is not stealing if you like, but the penalties will happen anyway. It may appear that way only because police and other authorities have been slow to understand complex digital crime and prefer to offload it 'as a commercial matter' to save brain explosions.

Only last week a fraudulent ponzi scheme was passed off by PC plod as a 'commercial matter' because they couldn't get their head around it. When the penny does drop it will be too late to catch the perps who have left the country, and a cold money trail. Any offence is extraditable if the potential outcome of a guilty verdict is a period in prison. All of NZ law is online and searchable. Suggest you start learning how to use google instead of continually repeating your incorrect 'not a crime' mantra. If you were on holiday in Singapore and stole a rickshaw to get to the airport to catch your flight home, you could be extradited back to Singapore. Copyright breach is stealing.

A good summary. A witch-hunt is under way. John Key may not give 'a toss about this' or instinctively align his preferences with the hugely wealthy Hollywood corporations after Dotcom. Regardless of the fiasco before the last election, Dotcome deserves all the protection of New Zealand law. What ever happened to the concept of innocent until proved guilty? And heaven knows what a mess the US courts are - with too many travesties of justice revealed decades later. Our instincts should not be with the the predatory money boys.

I can not help but feel there is a very unhealthy government involvement in this whole saga. I have a distinct feeling that there is a scratch my back and Ill scratch yours. The US want Dot Com.no doubt about that, his business hurt some big wigs in the US and they are the ones who contribute to election funding. If any part of that is true then that is corruption at it's worst. If any part of our Government including the police original raid is any part of that then Dot Com is not the person who should be in the dock.and that comment must extend to our Judges as well and there has been a handfull of them. And what about Davidson who stood down as Dot Com's lawyer, on the basis Dot Com could not meet his bills (millions of Dollars) and was next appointed as a high Court Judge. I feel very concerned about the whole Dot Com saga, it has a very unpleasant smell about every part of it.

Yes but again the allegation is that Megapuload paid cash incentives to the uploaders of infringing files, kept some of those files on its site rather than taking them down as soon as possiible under safe harbour laws, and made them more easily discoverable despite its public statements it did not. If true, those allegations set Megaupload apart from other file sharing services (which, as noted, all contain infringing material). And again, the US govt can't be simultaneously under the sway of Google and the movie studios, which have opposing takes on file sharing.

Absolutely thrilling to read about American Jurisprudence and 90 years of imprisonment! By the time 90 years is up, what do the authorities do with a 140 year old body, even if a rather 'plump' one? Concurrent charges, yes, but really, how rediculously absurd: 90 years?

American Jurisprudence is laughable in the circumstance. Dotcom, plead insanity and America might incarcerate you for half a lifetime! Better, ask to be deported to Syria. The whole matter then can blown out all proportion to the crime. If he had just fronted up to the Americans in the first place to answer for his alleged crimes, he probably could have plea bargained this down to a prison term of less than 5 years, maybe even as low as three or less, to be served in a fairly relaxed federal penitentiary. These are after all crimes against property and large corporations and not so much individuals. He's hardly Hannibal Lector!

He had to go and get himself all uppity about it and dig his toes in and cause a whole lot of trouble (encouraged by a lot of dumb anti-American bigot New Zealanders - excluding his legal team of course). So he's blown that chance now hasn't he?

When they do eventually get him they'll throw the book at him just to make an example of him. Yes, our current or future Minister will have the final say and should take the opportunity to reflect long and hard on some of the major differences between the two countries that this case so perfectly illustrates.

Here, there is a degree of under-sentencing for both white and blue collar crimes. There there is an almost farcical degree of over-sentencing and this is amplified by many other factors, including race, xenophobia, the defendants' wealth and class and the political ambitions and allegiances of the prosecutors. The bottom line is that Kim Dotcom could, indeed, be given a literal life sentence in a US prison, whereas, for the same crime fully prosecuted here, he would spend a few years in a minimum security prison and then be released on home detention. Most people who hold the view that Dot Com should be allowed to stay change their mind when asked would their viewpoint change if it was their income that was impacted by someone profiting out of illegal distribution of their works.

It is all too easy to label 'Hollywood' as some faceless and personally nameless corporation. In reality however 'Hollywood' is made up of people, not all of whom are hideously rich, and who take massive risks in acting, singing and financing movies. They are people, not mechanoids.

Note that Steve Jobs was a big part of Hollywood, and set up iTunes to protect the right of artists, much to the annoyance of Steve Wozniak, who believed in free sharing of things including other people's works and supported Dot Comz point of view. Steve Jobs stance on copyrighting was cemented when he became an artist with Pixar Media. Why shouldn't artists and their agent and management companies, defend their intellectual property rights in the same way any of us would when some rogue sets up a system to exploit those rights and financially benefit? No matter how you look at it ethically or legally, copying or inciting to copy someone else's creative work is theft. Condoning such activities to go unpunished, means setting aside a basic tenet of a free society - the right to life, liberty, and the fruits of ones labour. Like Bernard Madoff, Frank Abagnale, and Al Capone, Dot Com thinks he is untouchable, and fueled by a delusion that he is so clever that he can mentally and technically run rings around his pursuers, garnering support from people who have bought into his delusion. He fundamentally believes the authorities to be stupid.

He should take a lesson from Frank Abagnale and stop running, admit his mistakes. With genuine remorse he will no doubt get a lighter sentence and be out in a few years and be an Internet security consultant. The more he resists, the worse it will be for him. Hollywood the victim? Movie makes moved from the east coast of America to California to skip paying patent royalties on film equipment, Hollywoods very creation was that of Fraud!

Then you have the scores of actors, screen writers who have had royalty payments for the sweat of their brows stolen from them by the studios dodgy 'Hollywood Accounting' The writer of Forrest Gump who thought he was entitled to 3% of the profits of the film has never seen a percentage royally payment because a film that made $678m Box Office receipts on a $55m production budget has never to this day made a profit! Then the last truly great Hollywood scam is the Tax Avoidance Scam they have played out on countries throughout the world. We will only make our movie in your country if you give us a 10-15% rebate on everything we spend. The only industry in the world that gets this type of 'rebate' which increases the tax burden on regular Joe tax payers to the tune of $100m's annually. And I'm not even going start of the scams executed by music executives keeping Billions of dollars of artist royalty payments over the decades for themselves. Hollywood and the Music industry are extremely effective at achieving their objectives.

Take the rebates on movie productions as an example of their effectiveness. No other industry gets this kind of a government handout for creating temporary jobs using shell companies. Their latest scam appears to be getting to use tax payer dollars in New Zealand to shut down MegaUpload and try extradite it's villainous leaders to the USA. Given Viacom loosing out to Google re:YouTube in civil court trying criminal proceedings looks a great low cost model to shutdown a business you don't like.

And as for the $500m industry damage, it's a joke, not a single media industry funded assessment into the damages of file sharing hasn't been debunked for over inflating industry losses. (Hint: 13 year old boys downloading 200 movies and 300 albums while getting $20 a week pocket money is not a $15,000 loss to the industry). Merry Xmas, Kim. During the festive season, try hard not to think about Leavenworth, or Folsom, or San Quentin, or USP Marion, or Angola; and how John Key laid the red carpet down (as well as himself), at the feet of the Warner Bros. Honchos when they came here to read him the riot act over the making of the - mind-numbing -'Hobbit' trilogy; and how JK much prefers, for his Xmas fare, kosher over bratwurst and 'sauerkraut'.

Speaking, of which, I see you are bracing yourself for more disappointment by what's in the fruit bowl. In life, you have to pick your battles. It is very difficult to fight the establishment, and the power they have over government. They have an endless pit of tax payer money, and they only think that will stop them is periodic elections. The financial system is almost broke, due to the greed of a few and banksters are right up there. With any luck, a change in government will hunt out some of these greedy monster; enough so they pull their heads in. Shutting down tax havens would go a long way to achieving this.

Extremist would be better off targeting these havens, rather than the general masses.

DOWNLOAD Break Me Down mp3: DOWNLOAD Bring Me Down (Original Piano piece by R0ckstar): LYRICS I remember the times when life was just shockin me.

Pick me up and show hypocrisy. Its like a wall, just standing there blocking me. With nothing to do, except pary for God to be There. And i don't know why but I'm scared. And now my heart is under repair. Makes you wonder if love and peace were ever something to exist.

Break me Down. Break me Down. And my life around. It just takes the best of us and breaks it down to none. Break me Down (down) Break me Down (down) How you like me now?

You thought i was crazy then, listen to me now. So I had once defined a clear dividing line between mad and fine.

So I could then go find at what point I lie on this graph of mine. The results were not too kind. One could see, empirically that I'd lost my mind. Specifically in between, psycho and delirious. Eh, why so fucking serious?

Sit back and remember being a member of this chapter. When the girls were faster. And we spent out days in the sun saying fuck the world, and raising the guns. Our dream deferred, like a raisin in the sun. But I dont shrivel I shine, like the rays of the sun.

Now I gotta, move with swagger, swift as a dagger. Move on from this chapter, to climb the ladder. Its now or never For worse or for better I determine my worth, going for the cheddar.

Cause life only comes once, its dont come twice. So get your motherfuckin hand up and fight. I aint getting my bread, I'm getting that rice and. Hit you hard on the mic like Tyson.

To the red black and white i swear loyalty Even if you deploy me you can never destroy me. Last year, my friend Boyd AKA R0ckstar picked up playing the piano. He would practice in the piano rooms at our school's music department, and take his laptop to record his practice sessions. He played some of the recordings back to me, and we talked about how cool it would be to turn them into some beats.

These are a couple of tracks i did with his recordings back then. They're pretty rough and incomplete, but i thought i'd post them anyways b/c some people i know were asking about them. I always wanted to go back and develop them some more, but i got lazy. The original recordings were done with a laptop mic, so the quality isn't too clean.

But it makes the tracks grittier and that much cooler:) Track 1 (Linkin Park - What I've Done) The original track is Boyd playing his own piano version of Linkin Park's 'What I've Done'. You'll hear the original recording kick in at the end. DOWNLOAD mp3 Track 2 (Bring Me Down) The original track is Boyd's piano version his other friend's original song 'Bring Me Down' (which was a guitar/rock song).

So I guess that makes this a third derivative? DOWNLOAD mp3 Track 3 (Untitled) This was an original piece arranged by Boyd. I think he said it was what he played to practice scales. DOWNLOAD mp3.
